Terms of Hosting Industrial Challenges

 

 

By creating an Industrial Challenge in TunedIT you agree to the following Terms of Hosting Industrial Challenges ("Terms").

Definitions. The "Organizer" or "You" means every user who creates and launches an online programming competition in a form of Industrial Challenge ("Challenge") on TunedIT Challenges platform ("Platform") located at http://tunedit.org/challenges and being a part of TunedIT website ("Website"). The Platform is provided by TunedIT Solutions S.C. M.Wojnarski, B.Łobodzińska ("TunedIT" or "We"), registered in Poland and operating at: ul. Żwirki i Wigury 93 lok. 3049, 02-089 Warszawa, Poland.

By using the Platform by viewing or displaying or publishing ("posting") any text, files, images, music, photos, video, sounds or any other work ("Content") to the Challenge or using any other feature provided by the Platform, you agree to be bound by these Terms and obey any applicable law.

Copyright. TunedIT does not claim any copyrights to the Content you post on the Platform. However, by posting any content on the Platform, you hereby grant to TunedIT a limited non-exclusive, fully-paid, royalty-free, sublicensable and worldwide license to use, modify, display and perform, reproduce and distribute the Content solely on and through the Website. The license will terminate at the time the Content is removed from the Platform.
Prohibited usage. The Challenge must not contain or promote any Content that: is unlawful, harmful, threatening, abusive, vulgar, obscene or pornography; infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

Responsibility. The Organizer is the sole responsible party for configuring, publishing, opening, promoting and finalizing the Challenge, as well as for paying the awards (if any) and transferring Intellectual Property ("IP") rights.

Prizes. The Organizer may give one or more prizes ("Prizes") as a result of the Challenge, during or after the Challenge, in cash or in any other form chosen by the Organizer. Information about values and form of Prizes, as well as the rules how they will be awarded (eligibility, time), should be published on the Challenge web page. The Organizer is obligated to pay to participants all the due prizes in proper amount and time, as declared on the Challenge web page.
Commercial purpose. The Challenge can have commercial purpose. In particular, it is allowed that the Organizer requests one or more Participants to transfer Intellectual Property rights ("IP") to their algorithm(s) as a result of the Challenge. Information about the form and subject of IP transfer must be published on the Challenge web page.

Hosting fee. The Organizer will pay a fee ("Fee") for hosting the Challenge on the Platform, in amount and due time agreed separately with TunedIT. As long as the Challenge is in the draft mode, i.e. not published yet, its hosting is free of charge.

Single contest. You will not organize the same contest in parallel on any other website. You will not include links to nor advertise in any way the web sites that provide similar services as TunedIT.

TunedIT Intervention. TunedIT reserves the right, without notice and in its sole discretion, to introduce changes of any kind in the Challenge configuration and state. TunedIT may remove the Challenge if it violates these Terms.
Disclaimer. The Platform is provided "AS IS", without guarantee of any kind. You use the Platform at your own risk. Although we work hard to keep the Platform online and working, we take no responsibility for possible errors, damages, lost content, malfunctioning.
Refund. In case of serious malfunctioning of the Platform that makes impossible to carry out the Challenge, or removal of the Challenge by TunedIT, TunedIT will refund the Fee paid by the Organizer.
Governing Law. These Terms are governed by the laws of Poland.
Changes. The Terms may change at any time, without prior notice. The current version is always available at http://wiki.tunedit.org/legal:industrial.
